The New Era of Data Privacy and Protection in China

China’s data protection and privacy law has for many years been a daunting hurdle for businesses seeking to enter the world’s largest digital economy. Previously, the law was considered by many as disjointed and overly broad. Then in 2020, the PRC Government announced several significant reforms in China’s data protection regime, most notably the draft Data Security Law and the draft Personal Information Protection Law. These changes have elevated China’s approach to data protection by creating a set of comprehensive laws that create new obligations for organisations in the collection of personal information. Does this new framework sufficiently address the challenges that existed under the previous regime? How can an organisation build adequate data processes to ensure compliance with the new laws?
